Customer Privacy and Protection Policy

This agreement applies to all customers who are offered or receive compensation from Ace Grading under the Fair Market Value Policy (FMV). 

Compensation payments may be issued in the form of Ace Credit or as a BACs payment and is contingent upon the customer agreeing to the confidentiality terms outlined in this agreement. 


1.0 Confidentiality Implementation 

1.1 When a customer becomes eligible for compensation under the FMV Policy, Ace Grading will issue this Customer Privacy and Protection Agreement to establish the terms of confidentiality surrounding the process. 

1.2 The customer must confirm acceptance of this agreement before any compensation payment is processed or released to them.

1.3 These confidentiality terms are designed to protect the privacy and integrity of all communications, valuation assessments, and settlement details between the customer and Ace Grading. 


2.0 Confidentiality Conditions 

2.1 By accepting this agreement, the customer agrees not to discuss, publish, or share information through any medium related to the circumstances, resolution or compensation of any instance in which the FMV Policy is initiated by Ace Grading.

This includes, but is not limited to: 

  • social media platforms, 
  • online forums and communities, 
  • private or public digital groups and messaging platforms. 

2.3 These confidentiality obligations help maintain the professional integrity and fairness of Ace Grading’s FMV Policy for the customers best interest in resolution to any instances where the FVM Policy is initiated. 


3.0 Declining the Agreement 

3.1 Customers who choose not to accept this agreement may have any compensation offer reduced or withdrawn.

3.2 In such instances, Ace Grading may consider the matter closed and cease to engage in further discussion or negotiation regarding the incident or compensation.


4.0 Breach of Confidentiality 

4.1 Any customer who violates the confidentiality terms of this agreement may be subject to Ace Grading considering the matter closed and cease to engage in further discussion or negotiation regarding the incident or unpaid compensation offers being withdrawn.

4.2 Any customer who violates the confidentiality terms of this agreement may be subject to legal action by Ace Grading Ltd. Legal remedies may include, but are not limited to: 

  • seeking damages for reputational harm, and/or:
  •  recovering financial losses resulting from the breach. 


5.0 Customer Rights 

5.1 Customers have the right to receive all information relating to any incident that triggers the initiation of the FMV Policy, including any relevant submission information or compensation offer made before agreeing to this agreement. 

5.2 Customers may choose not to accept the confidentiality terms; however, doing so will result in the immediate withdrawal of any compensation offer, and the matter will be considered closed. 

5.3 Customers who accept this agreement acknowledge that it must be upheld in full and may not be altered, modified, or breached in any way. 


6.0 Ace Grading’s Rights 

6.1 Ace Grading reserves the right to introduce this agreement at any point during discussions relating directly to a customer’s submission where confidentiality is deemed necessary. 

6.2 This agreement may be initiated even if no compensation has yet been offered or issued. 


7.0 Duration 

7.1 The confidentiality obligations under this agreement will remain in effect for 12 months from the date of acceptance, unless: 

  • Ace Grading provides written confirmation that the confidentiality requirement is no longer in effect; or 
  • A new Customer Privacy and Protection Agreement is executed between the same parties.


8.0 Acknowledgment 

8.1 By agreeing to this Customer Privacy and Protection Agreement, both Ace Grading and the customer acknowledge their mutual understanding and acceptance of these terms as an essential part of the FMV Policy and related compensation process.
